PLAYBOOK SERVICES SUPPLEMENT

This Playbook Services Supplement ("Supplement") applies solely to Playbook Services identified in an applicable Order Form. Except as expressly modified by this Supplement, the EE End User License Terms and Conditions ("EE Terms") govern Customer's purchase and use of the Playbook Services. Capitalized terms not defined herein have the meanings given in the EE Terms.

1. Scope

Playbook Services consist of EE's hosted Playbook platform, hosted computational resources, Playbook Datasets, Updates, and related Products identified in an applicable Order Form.

2. Additional License Rights

2.1 Subject to the Agreement, EE grants Customer a limited, non-exclusive, non-transferable, non-sublicensable right during the applicable Term to access and use the Playbook Services solely for Customer's internal business purposes.

2.2 Access is limited to the number of Playbook Named Users purchased under the applicable Order Form.

2.3 Unless expressly stated in an Order Form, Playbook Services do not include rights to install Software locally or access EE cloud environments outside the Playbook Services.

2.4 EE may modify or update the Playbook Services provided such modifications do not materially diminish the overall functionality of the Playbook Services.

3. Playbook Dataset Terms

3.1 Playbook Datasets constitute Dataset Services and Customer's use of Playbook Datasets is subject to both this Supplement and the Dataset Services Supplement.

3.2 Playbook Datasets may only be used in connection with the Playbook Services.

3.3 Customer may include limited portions of Playbook Datasets in reports where such use is incidental, limited to the minimum reasonably necessary, and accompanied by attribution to Energy Exemplar.

3.4 Customer may disclose limited portions of Playbook Datasets in regulatory, administrative, or judicial proceedings where reasonably necessary, provided no material portion is disclosed except where legally required.

4. Compute Credits

If Compute Credits are included in an Order Form, Customer's hosted computational usage will be measured using Compute Credits. Additional Compute Credits may be purchased during the Term. EE may invoice applicable overage charges or suspend initiation of new simulations after Customer exhausts purchased Compute Credits, as provided in the applicable Order Form.

5. Product-Specific Restrictions

5.1 Customer shall not publish or disclose any benchmark or competitive evaluation of the Playbook Services without EE's prior written consent.

5.2 Customer shall not use the Playbook Services or Playbook Datasets to develop or commercialize a competing modeling platform, dataset, or artificial intelligence system.

5.3 APIs, SDKs, and automation interfaces may be used only in accordance with EE Documentation.
